PayDay Offer
These General Terms and Conditions («GTC») apply to the services offered by «Payfresh AG», operator of the PayDay website with headquarters in 8002 Zurich, Switzerland (hereinafter «PayDay»), and to interested parties or customers of this platform (hereinafter «Interested Party» or «Customer»).

PayDay assumes outstanding invoices (mainly «Utility Bills» such as electricity, heating, telephone, school costs, etc.) or purchases of its customers up to a maximum total amount of CHF 499.0. The customer must repay the amount paid by PayDay including fees within 30 days. The repayment period never exceeds three months. The service is offered exclusively online via the PayDay platform.

PayDay's offer is only directed at natural private individuals who reside in Switzerland and have a regular income.
Registration, acknowledgment of GTC and KYC

Registration process
Registration takes place online via the PayDay website. The interested party pays the one-time registration fee and/or the annual fee. Payment can be made online by credit card, Postfinance card, PayPal or within 7 days by invoice. If payment is not made within the deadline, the account is automatically closed and all customer data is deleted. The interested party can register again upon request.

The interested party receives a verification code sent to their mobile phone; this must be confirmed via the platform. Furthermore, they receive an email which must also be confirmed by clicking, thereby verifying the personal email address. As part of the registration process, the interested party declares that they have carefully read and understood the GTC.
KYC (Know your Client) and creditworthiness check
Since PayDay advances payments for customers, it is extremely important for PayDay to know its customers and ensure that the information provided is correct and that the interested party can repay the paid invoices including fees within the deadline.

As part of the registration process, a KYC check is therefore carried out by verifying the information as well as through our own research. The interested party must upload the following documents to the platform:
  • Copy of passport / ID or foreign permit
  • Proof of residence
  • The last 3 salary statements to confirm regular income

As soon as all information is completely available, it is checked and confirmed. PayDay reserves the right to consult credit agencies such as ZEK, IKO, CRIF. By accepting these GTC, the interested party declares their consent.

After payment of the registration and annual fee and successful verification, the interested party becomes a customer and can use the service.
The legally prescribed KYC check for anti-money laundering purposes is carried out separately.

Correct and current information
The interested party/customer is obligated to provide correct and current information. Only one registration per person is allowed. Violations will be legally prosecuted.
All personal data and documents must be kept up to date. In case of changes (e.g., residence, employer, passport expiration), immediate notification via the platform is required.
PayDay can request document updates at any time. In case of non-compliance, access can be blocked. In case of misuse, PayDay can demand compensation.
PayDay can refuse or cancel a registration at any time without justification.

Use of Services

Usage window
The PayDay service is available to the customer during the so-called usage window. A usage window always begins on the 5th of the month and ends on the last day of each month. On holidays and weekends, PayDay does not execute payments.
During a usage window, invoices can be submitted for payment up to a total amount of CHF 499.0. Within this amount, the customer can have multiple invoices paid. The effective amounts of the submitted invoices without PayDay fees are decisive.
The invoices can also be in the name of third parties. However, only the customer remains the contractual partner and debtor towards PayDay.
PayDay only pays correctly submitted invoices (e.g., with correct reference number) and can refuse invoices at any time without giving reasons.
After each use, the customer receives an invoice including fees. Only after its payment is a new usage window opened.

Billing cycle
When the customer starts an order for payment of invoices, a so-called billing cycle is opened. Within a cycle, the customer can submit one or more invoices via the PayDay platform.
A billing cycle lasts from 00:01 to 23:00. The customer can add additional invoices during the day as long as the cycle is open.
The minimum amount per invoice is CHF 20.00, the minimum amount per cycle is CHF 50.00.
PayDay strives to check submitted billing cycles within 4 working days and execute payments. Delays due to missing information or technical problems are possible.
Payment of an invoice by PayDay
Payment is made on behalf of the customer. This does not constitute debt assumption by PayDay. The original contractual relationship between customer and invoice issuer remains.

Fees, Payment Terms and Default Consequences

Basic fees

Registration fee
The one-time registration fee amounts to CHF 19.9.
It serves to cover the costs of the manual verification process. After payment of the fee, a refund is excluded in case of incomplete KYC verification.

Annual fee
The annual fee amounts to CHF 19.9. A proportional refund in case of early contract termination does not take place.
After payment and successful verification, the platform can be used for one year. Repeated creditworthiness checks are omitted during this time.

Fees for services
Basic fee for invoice payment service
The basic fee per billing cycle amounts to CHF 19.9 and includes payment of one invoice.
For each additional invoice in the same billing cycle, the customer pays only CHF 4.9.
Example: If the customer submits three invoices to us for payment (CHF 175.00, 125.00, 150.00), this gives a total of CHF 450.00. Then the customer pays a total of CHF 464.70.
Administrative fees

For delivery of invoices in paper form, CHF 2.50 is charged per invoice/reminder.
Deposits at the post office counter cause additional costs of CHF 1.50, which are charged to the customer account.

Fees for optional services
To extend the repayment period, the customer can choose the "Buy more Time" option.
Option 1: CHF 19.9
This option can be chosen between the 20th and 24th day after use and extends the payment deadline by 30 days.
If the option is chosen, the customer receives a new invoice with the new payment deadline +30 days.

Payment terms
The customer receives invoices by email. These are also visible in the profile on the platform.
Payment must be made by the date specified on the invoice at the latest.

Default consequences
Reminder
If the payment deadline expires, the customer automatically falls into default.
The first reminder occurs 30 days after expiration with a fee of CHF 25.0.
The second reminder occurs 40 days later with a fee of CHF 25.0.
The third reminder occurs 50 days later with a fee of CHF 40.0.
60 days after the third reminder, the file is automatically transferred to a debt collection agency.
All reminders are sent by email.

Debt collection
When debt collection is initiated, a flat fee of CHF 50.00 is charged. Additional costs from the debt collection agency may be added.
The customer profile is blocked. Reactivation is only possible after the membership expires.

Reactivation fee
For reactivation of a blocked account after membership expiration, a fee of CHF 35.00 is due.
Examples for fee calculation
Example 1: Two invoices with a total of 280.00 CHF result in an invoice of CHF 289.70: 280 + CHF 19.9 + 2 x CHF 4.9
Example 2: A third invoice, submitted through a new billing cycle, of 170.00 CHF results in another invoice of CHF 184.80: 170 + CHF 19.9 + CHF 4.9.
A new usage window is only opened when all outstanding invoices are paid.
After full repayment, the service can be used again up to CHF 499.0.
The usage window closes automatically on the last day of the month at 23:59.
From the 1st to the 5th of the month inclusive, no invoices are paid by PayDay.

Data Protection

The customer agrees that PayDay processes personal data for the purpose of providing services. More detailed information on data processing can be found in the privacy policy.

Duration & Termination

Contract duration / early termination
After registration, the customer can use the platform for one year. The contract duration results from the expiration date visible on the platform (usually 365 days from payment of the annual fee).
The customer relationship does not automatically renew. Before expiration, a reminder is sent by email as well as directly on the platform.

Early termination
PayDay can terminate the contract at any time without giving reasons.
Early termination occurs in particular when the customer falls so far into default that the file must be transferred to debt collection. In this case, the customer remains blocked for the current membership year – even after payment via debt collection.
In case of GTC changes, the customer can terminate within 30 days. Existing payment obligations remain. A refund of the annual fee does not take place.

Additional Provisions

Amendment of General Terms and Conditions
PayDay reserves the right to adjust the GTC (incl. services and fees) at any time. Changes are appropriately communicated and are considered approved unless the contract is terminated before taking effect.

Severability clause
Should individual provisions of this contract be wholly or partially invalid, the validity of the remaining provisions remains unaffected. The parties commit to finding an economically equivalent regulation.

Applicable law, jurisdiction
This contract is subject to Swiss law. The place of jurisdiction is Zurich, subject to mandatory legal provisions.

Anti-Money Laundering

Customer identification (KYC)
PayDay checks the identity of all customers before providing the service. For this purpose, a copy of the ID and three salary statements or bank statements must be submitted.

Due diligence
PayDay monitors transactions for compliance with legal provisions and initiates further investigations in case of irregularities.

Cooperation with authorities
In case of suspected money laundering, PayDay cooperates with the competent authorities (e.g., MROS).

Training and processes
PayDay regularly trains its employees on AML requirements and implements internal processes to comply with the provisions.

Legal consequences
In case of violations of AML guidelines or suspected money laundering, PayDay can block accounts or terminate the contract. These measures serve the active implementation of legal requirements.

Liability Disclaimer for Platform Malfunctions and Payment Delays

Liability disclaimer for platform malfunctions
PayDay assumes no liability for technical disruptions or delays in transmissions and payments, unless these were caused intentionally or through gross negligence. Technical problems must be reported immediately.

Liability disclaimer for third-party fees in case of late payment
PayDay is not liable for reminder fees, default interest, or other costs that arise due to late payment to third parties. The customer bears the responsibility for timely submission of invoices and their payment.
